This policy applies to all customers of Southern Elements (Pty) Ltd. (Purchaser).
Southern Elements does not work on any credit or account basis, we do not allow 30 day accounts or any type of post payment method. All sales will only be released upon full payment up front.
Orders below R10,000 can be processed for collection upon payment with a .pdf POP from the bank (no images or screenshots). Orders above R10,000 will only be released unless complete funds have cleared into our accounts.
All sales are final and subject to the Terms and Conditions of sale and Warranty Policy. It is the responsibility of the Purchaser to understand the specifications, limitations, applicability and suitable usage of Products. Product returns will only be accepted under the terms of Warranty specified below and not in the event where the Products are deemed to be unsuitable by the Purchaser.
The Warranty Period is defined as 12 months from date of delivery of Products to the Purchaser.
The Seller warrants that the Products:
- Are suitable for the purpose for which they are generally intended, of good quality, in good working order and free of defects
- Will be durable for a reasonable period if the goods are used appropriately and for the purpose for which they are generally intended
If a Warranty claim is asserted by the Purchaser during the Warranty Period the Seller will repair and replace the Products or parts thereof free of charge subject to the following conditions:
A Warranty claim is valid if:
- The delivered Product(s) or parts thereof are proven to have material or manufacturing defects, and
- The Purchaser notifies the Seller of the defect alleged within the Warranty Period and within 7 days of its discovery.
A Warranty claim is not valid if:
- Malfunctions or failures result from misuse, abuse, neglect, alteration, problems with electrical power, usage not in accordance with product instructions, acts of nature, or improper installation or improper operation or repairs, or
- Products of parts thereof become damaged as a result of natural wear from normal use, or
- Consumable materials and accessories become damaged, or
- Products are improperly used or damaged externally (in particular as a result of falls, impacts or water damage).
In the event of a defect arising in the Products at any time, the Purchaser will notify the Seller in writing of such defect within 7 days of its discovery. If it is within the Warranty Period then the Seller will reply stating whether it accepts Warranty liability pursuant to the above and indicating what action it proposes to take (which action may include further investigation by the Seller’s service engineer). If transpires that the defect is not covered by a breach of the Warranty, then the Seller reserves the right to make a reasonable charge for such investigation.
If the Warranty Period has expired, or if the Warranty claim is not valid, the Seller will offer advice (free of charge) and may offer repair or replacement at the Purchaser’s expense.
Note that certain products are defined as consumables and there is no warranty period and repair service is unavailable.
